Planning Commission meeting of July 19, 2022: Meeting and Public Hearing for Conditional Use Permit for Retail Marijuana Dispensary

By RICK ZYLSTRA/for The Herald  —  The meeting was called to order shortly after 7pm with roll call. The meeting had a quorum with four of seven commissioners present. Meeting minutes from the January 18th, 2022 meeting were approved shortly after.

There was no citizen input that didn’t directly relate to the proposed Conditional Use Permit.

The meeting moved into the Conditional Use Permit session for a Retail Marijuana Dispensary at 48257 E. First Street. There was no conflict of interest/ex parte contact declared by the commission.

Public Hearing

The Project Manager for the proposed retail dispensary gave his testimony and background into the company.

There were no Statements in Favor for the proposal

There were Statements in Opposition to the proposal from Dave Ackland, where he stated that he don’t want to live by a dispensary, and he don’t feel like it would be a good fit in the uptown and next to Banner Park. He cited traffic, both foot and vehicular, and kids in the area. The Commission requested the business representative respond to the concerns raised by the citizen. This ended up in a back-and-forth conversation between the representative and the citizen with a conversation that didn’t pertain to the criteria outlined by the Conditional Use Permit (CUP) nor the Planning Commissions quasi-judicial requirements of the hearing.

There was one Statement in General that was emailed to the commission by Lynda Kamerrer. She stated that a year-round business would be an asset to the businesses district. She gave recommendations on how to potentially use the building regarding compatibility with the buildings nearby.

The Planning Commission Chair, Kevin Gobelman, reminded the commission that their job was to judicate the application against the current ordinances on the books and not to assess the viability of the business.  The Staff Report was then read into the record as the Finding of Facts.

Staff report

The Planning Department of Lane Council of Governments (LCOG) had prepared the Staff Report. It concluded that the proposed CUP met the current ordinances and applicable criteria of the City of Oakridge. The report recommended approval of the request.

The Public Hearing was closed shortly after the reading of the staff report. Commission Actions of all commissioners present voted to approve the CUP for the Marijuana Retail establishment.

With no further business for the Planning Commission the meeting was adjourned at 7:44pm.
