NOXIOUS GROWTH PUBLIC NOTICE
LEGAL NOTICE
PURSUANT TO CITY OF OAKRIDGE CODE OF ORDINANCES CHAPTER 93, NUISANCES (93.32 NOXIOUS GROWTHS PROHIBITED, 93.30 DEFINITIONS, AND 93.33 PUBLIC NOTICE)
By City Ordinance: No owner or person in charge of real property shall allow noxious growth on the property. Noxious growths are hereby declared a nuisance. [93.32(A)]
It shall be the duty of any owner or person in charge of real property to abate noxious growths from the property. The owner and the person in charge shall be jointly and severely liable for the cost of abatement as provided in this subchapter. [93.32(B)]
Definition of noxious growth:
- Weeds more than 12-inches high,
- Grass more than 12-inches high,
- Poison Oak,
- Poison Ivy,
- Vegetation that is
- A health hazard
- A fire hazard
- A traffic hazard, because it impairs the view of the public thorough fare or otherwise makes the use of the thorough fare hazardous.
- Blackberry bushes that extend into a public way, a pathway frequented by children, cross a property line or that are used for habitation for trespassers,
- Noxious growth does not include vegetation that constitutes an agricultural crop unless that vegetation is a health hazard, a fire hazard, or a traffic hazard. [93.30-Definitions]
Definition of person in charge: Any agent, occupant, lessee, contract purchaser, or person other than the owner, having the possession, or control of property. [93.30-Definitions]
The City of Oakridge intends to abate all noxious growth ten or more days after the final publication of this notice. Additionally, the City of Oakridge intends to charge the cost of abatement it undertakes on any particular parcel of property, to the owner or person in charge thereof, or the property itself.
